Civil ProcessCivil Process
The mission of the Civil Process Division is to assist attorneys and pro se litigants by first processing and then delivering, or “serving”, the legal documents necessary for civil courts to conduct their business. The Division performs legal service of court documents by delivering them to defendants and others, thereby commencing lawsuits, summonsing witnesses and giving notice of protective orders. After the courts make judgments, the civil process staff and deputies enforce these judgments by seizing property, garnishing wages, conducting Sheriff’s sales and performing civil arrests. These civil arrests are performed when a “Capias” has been issued by the court. A civil capias is issued when the court finds the defendant in contempt. Our Department’s Enforcement Unit works collaboratively with the Massachusetts Department of Revenue’s Child Support Enforcement Unit to serve notice upon and, if necessary, arrest parents who are delinquent in paying their legal child support obligations. The daily work of the Civil Process Division is wide–ranging and often fast-paced. Deputies also spend a majority of their day in the community serving notices for many different types of clients. Clients range from large and small law firms, businesses and individual citizens, most want to know when service has been made so that deadlines have been met or that they are protected by a court order. Civil Process continues to stress improved communication through the relaying of important information in a timely and efficient manner to our customers, attorneys and pro se litigants. The entire civil justice system has benefited by the improved efforts of Suffolk County Deputies to relay accurate and timely information to customers. Our efforts have greatly enhanced the efficiency of civil litigation here in Massachusetts and across the country.
